Important: TradeProAnalytics is a data visualization and analysis tool. It does not provide trading signals, investment advice, or execute trades. It does not connect to any brokerage accounts. Users are solely responsible for their own trading decisions.
1. Agreement to Terms
By accessing or using TradeProAnalytics ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
TradeProAnalytics is a data visualization tool that allows users to upload backtest spreadsheet data and generate charts, statistics, and reports. The Service is similar to spreadsheet applications like Excel or Google Sheets, but specialized for visualizing trading backtest data.
The Service does NOT:
- Provide trading signals or recommendations
- Offer investment, financial, or tax advice
- Connect to any brokerage or trading platform
- Execute trades or manage portfolios
- Guarantee the accuracy of any calculations or visualizations
3. User Accounts
When creating an account, you agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Be at least 18 years of age
You are responsible for all activities that occur under your account.
4. Acceptable Use
You agree NOT to:
- Upload malicious files, viruses, or harmful content
- Attempt to access other users' data or accounts
- Use the Service for any illegal purpose
- Resell, redistribute, or sublicense the Service
- Interfere with or disrupt the Service's infrastructure
- Circumvent any access controls or usage limits
- Scrape, crawl, or harvest data from the Service
5. Subscription and Billing
TradeProAnalytics offers Free and Pro subscription tiers:
- Free tier: Limited features and data retention
- Pro tier: Full features, extended data retention, and priority support
Billing terms:
- Payments are processed securely by Lemon Squeezy
- Subscriptions renew automatically unless cancelled
- You may cancel at any time; access continues until the end of the billing period
- No refunds are provided for partial billing periods
- Prices may change with 30 days' notice
6. User Content
You retain ownership of all data you upload to the Service ("User Content"). By uploading User Content, you grant us a limited license to:
- Store and process your data to provide the Service
- Create visualizations and statistics from your data
- Make backups for data protection purposes
We will not share, sell, or use your User Content for any purpose other than providing the Service to you.
7. Intellectual Property
The Service, including its design, code, features, and branding, is owned by TradeProAnalytics and protected by intellectual property laws. You may not:
- Copy, modify, or create derivative works of the Service
- Reverse engineer, decompile, or disassemble the Service
- Remove any proprietary notices or labels
- Use our trademarks without written permission
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
We specifically disclaim:
- Any warranty of accuracy of calculations or visualizations
- Any warranty of fitness for a particular purpose
- Any warranty of uninterrupted or error-free operation
- Any responsibility for trading decisions you make
Past performance data visualized through this Service does not guarantee future results. Trading involves substantial risk of loss.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- We are not liable for any loss of profits, data, or business opportunities
- We are not liable for any trading losses or financial decisions
- Our total liability shall not exceed the amount you paid us in the one (1) month immediately preceding the claim
10. Indemnification
You agree to indemnify and hold harmless TradeProAnalytics and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
11. Termination
We may suspend or terminate your access to the Service at any time for:
- Violation of these Terms
- Fraudulent or illegal activity
- Non-payment of subscription fees
- Extended periods of inactivity (Free tier)
You may delete your account at any time through the account settings. Upon termination, your right to use the Service ceases immediately.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of New York.
14. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
